I wouldn't rush to file a law suit. Legal action should be a last resort. Maybe a friendly phone call to discuss the possibility of licensing use of FBR's version of DST. Mention the concern around the similarity of the technology and ascertain how similar each company's invention actually is. Perhaps a patent has been applied for and the patent office will compare the two systems.
