The takeover of Genex Power Ltd involved the transfer of the financial benefits of the $610 million still-secret "secret" concessional loan to the foreign entity J-Power.
Repeated efforts to ascertain from NAIF if it had obtained legal advice from the Solicitor General and or the Australian Government Solicitor that the transaction was legal have been futile.
NACC Commissioner Brereton and Inspector of the NACC, (Furness), have avoided the matter with Commissioner Brereton signing a report which ignored the crucial issue - why didn't NAIF require J-Power to refinance the concessional loan. Commissioner Brereton knew he was abusing his power when he signed the grossly defective report. Brereton knowingly and wilfully avoided the REFINANCE issue.
Given Inspector Furness has, seemingly, not taken any steps to investigate the actions of NACC officer, most particularly the actions and decisions of Commissioner Brereton, a complaint was lodged with the Commonwealth Ombudsman.

A response has been received to a FOI Request to NAIF. I need help to post it in better format. It has now been subject to AI analysis.
The findings of the AI analysis are indeed disturbing - systemic maladministration within the Australian Public Service is confirmed; starting with NAIF and going through ASIC, the Takeovers Panel, the FIRB, the AGS and of course Brereton's NACC.
I am pursuing this matter, not for any financial gain, but because of the corruption which has surrounded the transaction. The transaction has meant NAIF does not have $610 million for new development projects but the goals of Kidston and others were achieved. Kidston and others had seen Skip Capital as the way to liquidate their assets but when that was thwarted, because it was illegal, along came J-Power. For a second time legal advice from the Solicitor General and or the AGS was not obtained by NAIF.
The Commonwealth Ombudsman, (Mr Iain Anderson), I suspect, much to his and the Government' surprise, now has a complaint before him which requires him to investigate just what has gone on.
Hopefully I will be able to keep those of you who have followed this delving into corruption in the Commonwealth Public Service informed. What will follow will be my work aided and abetted by AI. Commissioner Brereton ought take note of this example of how AI can expose wrong doing.
