METGASCO COMMON SENSE
The decision by the NSW government not to appeal against the decision in the NSW Supreme Court in favour of Metgasco is a victory for common sense.
NSW Energy Minister Anthony Roberts has, in effect, confirmed that the government failed to understand the basic principles of the Petroleum Onshore Act.
The court said that the government failed to observe routine procedural fairness principles and took an interpretation of community consultation that was unreasonable.
The next issue for the minister to deal with is the amount of compensation payable to Metgasco.
