I think this is one of my questions. I thought I learned at uni law 101 that if it isnt in the constitution, it's a state issue.
Forget seeking an interpretation from the federal or high court, she needs to change the constitution. My point is, if this is the case then is this not creating a straw man to specifically hinder the LCK project and damage the share price?
Imagine if she said "we are going to pass legislation to ban fortescue" Or Bellamys? AFTER a state court ruled on it, where it is known the commonwealth has no jurisdiction
