Platinum Australia Ltd. reported the underground mining contract at the Smokey Hills Mine with Redpath Mining South Africa (Pty) Ltd. was terminated by PhokaThaba Platinum (Pty) Ltd, effective October 11, 2010. The performance of Redpath over the last 12 months has been consistently below that required under the contract and all attempts by PhokaThaba to work with Redpath to achieve an acceptable level of performance have been unsuccessful. PhokaThaba has served notice to Redpath of a dispute regarding a number of invoices which Redpath has submitted totalling about 50m Rand and also in respect of claims against Redpath for various alleged breaches of the contract which have resulted in significant costs and losses to PhokaThaba.
