Although complex the shares issued can be traced via the share registry and either cash came in or it didnt.
If people got CHM shares for no consideration and then sold these and have invested funds into MMX all this can be shown and laid out to court. It paints a grim picture for MMX.
CHM have laid bare these transactions to the court and MMX must now either provide alternative and believable reasons for these. (hard if Grimaldi isnt goint to take stand)
Alternatively current MMX management can accept that these transactions were dodgy but try and prove the amount contributed was "not significant".
Judge has to weight all this up and I believe form a view on compensation levels.
I can see a mix of Crossland shares and compensation orders against Barnes and Grimaldi coming to CHM. It wont be 50% of project but I believe it will be significant.
