The bread supplied by Subway in its heated sandwiches has a sugar content of 10% of the weight of the flour included in the dough,” Justice Donal O’Donnell said when delivering the judgment.

A spokesperson for the fast food chain hit back at the findings, saying “Subway’s bread is, of course, bread.”‘We have been baking fresh bread in our restaurants for more than three decades and our guests return each day for sandwiches made on bread that smells as good as it tastes,” they said in a statement.Subway is the world’s largest fast food chain with more than 1,300 stores in Australia and 38,000 worldwide.

The judgement was handed down in response to a Subway franchisee who had appealed for a tax refund, arguing that its bread is a “staple” food and therefore subject to a 0 per cent tax rate. The judges determined that Subway bread has too much sugar in it to be part of this category, and is therefore subject to a higher tax.

The Irish Supreme Court has ruled that Subway’s bread is not actually bread.A panel of judges said that the sandwich chain’s loaves could not be legally defined as bread due to its high sugar content and should actually be classified as confectionery.

I think subway might need to call our friends at hct, I’m sure the tax incentive would far outweigh the price of swapping to our superior product. Could get a two for one deal using both low gi and 80less sugar in their breads. If they want to be the freshest afterall and the healthier option would be in their best interests from a marketing prospective too. Might have to break out the old type writer and send a letter to subway.
