    PUTRAJAYA, Dec 19 — A group of Kuantan residents failed today in their bid to reverse the November 8 decision by the Kuantan High Court on the controversial Lynas plant’s temporary operating licence (TOL).

    A Court of Appeal here decided that it had no grounds to interfere with the exercise of discretion by the High Court, which had dismissed an application for stay of the TOL pending a judicial review.

    “We find the learned judge was lawful and correct ... We affirm to the decision of the learned judge,” declared Justice Datuk Ramly Ali.

    The appellants, represented by lawyer Datuk Bastian Pius Vendargon, were told to pay a sum of RM20,000 to the respondents.

    Save Malaysia Stop Lynas (SMSL) spokesman Tan Bun Teet conceded that they were not too disappointed with the expected outcome, and looked forward to the judicial review set for February 5 next year.

    “We would try to convince the court that there is ample ground and reasons for them to rule in our favour. If it did happen, then Lynas would have to cease operation.

    “It’s a little setback no doubt, but it’s a short time of two months, so it doesn’t really matter a lot,” Tan told reporters here.
