Not correct, frivolity implies a lack of law or fact to a claim, and would have unlikely made it this far.
I suspect that this will be about the validity of the patent, and whether it was truly innovative and not just a software implementation of an abstract or established business process.
Read up on Alice Corp. v. CLS Bank International (2014), a case that was pivotal in establishing the patentability of software and business processes.
