From my earlier readings, I thought the damage claimed was for missed milestone payments that would have been payable had NSL progressed to a JORC resource. It's not that NSL had to progress to a JORC resource.

Part of the plaintiffs argument in my interpretation appears to have been that based on the JORC resources identified in neighbouring tenements, if NSL had progressed the tenements to a JORC, milestone payments would have subsequently been triggered.

However the way in which it has been estimated that the resource would actually have been big enough to trigger the milestones is probably the contentious issue and is the evidence probably under question as to its admissibility.

Again, not a lawyer, just trying to interpret what I'm reading.

Either way, I suspect this minor inconvenience will soon be behind us.

In terms of conclusion, my feel is that the parties are now going to have to come to an amicable solution outside the courts.
