I this case both issues were played out. I think it is fair to say the Court does not understand the full implications of how either or both apply to the responsibilities and obligations of both employer and employee. If I were TNE I would vigorously defend the action of the company. The court seems to have had total disregard for the rights and obligations of TNE. Every day we see people who have perpetrated unspeakble acts get off scott-free after playing the mental health card. The employer is always the bully.
