    It may be a bit hard to read, but it looks like Tne will need to pay around $5m to the claimant for bullyingIn court cases around the world in recent times (Re Industrial Relations) a significant majority deal with:
    1. Bullying
    2. Mental Health.
    I this case both issues were played out. I think it is fair to say the Court does not understand the full implications of how either or both apply to the responsibilities and obligations of both employer and employee. If I were TNE I would vigorously defend the action of the company. The court seems to have had total disregard for the rights and obligations of TNE.
    Every day we see people who have perpetrated unspeakble acts get off scott-free after playing the mental health card. The employer is always the bully. No mention is made that the employee is giving poor service and that this has widespread consequences.
    Appeal. The Australian workplace needs clarification on the implications of mental health
