I have just got to say at this point that the hon. judges point made here, is conclusive for me:
"I am far from convinced that the position of individual members will be much different whether the exploitation of the minerals is done by Genorah as supported by Mr Mphalele or by the first applicant as supported by Mr Maphanga and Mr Mhlungu. Individual members are prejudiced by this litigation, in that the actual mining and development are delayed."
Imho, nations all over the globe are meeting regularly to stimulate economic production. Do you think that at this point in macroeconomic history that any judge would not want to expedite economic recovery, for all, particularly in SA? SA would be advantaged by the multimillion dollar JV and subsequent cashflow and JOBS, taxes etc to be generated from the mine, once it is in production, which needs to be as soon as possible. The sooner an economy reduces debt, increases cashflow the better all in the community will be.
