Just some info for those that aren't sure....
Arbitration is pretty standard these days after full document/discovery exchange. I don't know whether it was by direction of the Court or voluntarily sought by QLD Gov. As with this arbitration, discussions are also generally without prejudice.
Failure to reach an agreement may see it for final mention on 29 January 2013 then set for hearing date down the track. At that time Judge will hear evidence, witnesses etc from both sides. After which he/she will generally reserve decision until X date afterwards.
Then there is option of appeal from both sides. Appeal could be on various levels. Or simply by Government after CXY being awarded a shite-load in compensation. ;)
In short - don't hold your breath at this time, possibly a way to go yet. That's not to say Arbitration may not succeed and we get an Ann., funnier things have happened in the Law Game.
I'm still in the list to purchase. I still abstain my sentiment at this time though as it could go either way, although my hope is in favour of a positive CXY outcome, but that's my speculation.
