His Honour is simply going to wait and be better informed by the evidence as it plays out during the trial. It will certainly shorten the 21 March hearing of the Visa motion. That is, if the Defendants go down on the Visa count in the ASIC hearing, they may have a tough time resisting Visa's costs application re: the subpoena. And vice versa. Costs will follow the event.That makes sense. I would've thought that findings that are made in the upcoming trial will impact the outcome in Karantzis v FCT or be of significant relevance at the very least.
