Hi
@oscardada“just wonder why can't the court reject ASX and ASIC's request of delay providing the evidence? They keep my investment suspend almost 3 years already.....”
Here’s my rant / view point on how the system operates. All imo.
First up the system looks after the system. The courts are the system. So they go with the rules set in place to benefit the system and an outcome in the systems favour, even if it appears a negative outcome against the system they still turn a negative into a positive by the use of the tools at there disposal that the system has provided.
So let’s just say isx does win all this litigation, how does the system mitigate the impact of a negative outcome whilst sending the compliance message to all other parties. One of the answers is time, more next para. Everything in the system is about compliance or suffer the consequences, it’s the big stick we’re all being constantly bashed with. The law is only their to administrate compliance. It’s never about whats stated or what propaganda is spewed out, it’s always about controlling and managing the overall system so it gains and everyone else falls further behind.
Back to an example of how time mitigates - A protracted drawn out case straight up lessens the impact of any event, as well as any negative financial damages payable or received. As an example if $460 million was paid 5 yrs from the start of the court case with the effects of inflation at say 2-2.5% pa the payment is really only 403 to 414 million in todays terms. So straight up one wins in paying and the other loses in terms of buying power. So if you think your going get a negative outcome why rush the proceedings, your actually making money by postponing the outcome, and the other party is losing money / buying power. Either way it’s a win for the system.
So basically the isx matter has always been about control, the governance is just the excuse that’s used to administer out the punishment for having the audacity to question authority. It’s blatantly obvious the authorities have a case built on a sand foundation and that’s now being washed away. From here on its all about damage control for the authority because behind the facade is an empty shell. Amazing how long the system can keep playing the game though. A real eye opener, but when the system is designed for the benefit of the system it’s easy to orchestrate the proceedings.
As usual we all just have to flow with the show. It’s easier to handle the show when you know what’s going on, but it’s also disgusting because the system gets away with it and you can’t beat them at their game. Saying all that, I’m saying even if you win you loose because of all the damage and loss along the way that can never be recouped. Yeh some financial compensation is nice but thats just to appease you and to fool you into thinking you won. You can’t get back time and the effect of time.
All imo, GLTAH
All the best
