Full disclosure, i'm pretty ignorant of how the courts work in Australia, so i don't know if my opinion is valid. But i would have thought that if someone is taking someone to court it shouldn't matter if they can afford the cost of losing as justice shouldn't just be provided to those that can afford to lose otherwise in a David Vs. Goliath battle David would need to withdraw every time without the battle and Goliath would win by default in every instance.
Now having said that, ISX restructured to, by all appearances, limit their loss liability in Australia. If they truly believe they have a case that wont just drag on and require ever-more security being tacked on, then i'd like to see them stump up and take this to court. At this late stage it would be very unsatisfying to have wasted so much money and productivity for this to fizzle. I've paid for my ticket already, I want to see blood, i'm here for the show.
