Everybody look I may be stupid but the following which take2 gave us on todays proceedings:-

THE COURT ORDERS THAT:

1. The applicant have leave to file its Further Amended Statement of Claim.
2. The applicant pay the respondents’ costs thrown away resulting from the amendment.
3. Within seven days, the applicant provide security for the costs of the Third and Fifth Respondents in the sum of $125,000, such an amount to be invested in an interest bearing account.

To me a stupid person this reads. chm has now delayed the proceedings in order to file this further claim (which has suddenly come up, 2 years not enough time to do this in obviously). So now the trial is delayed once more, I firmly believe this is a delaying tactic on chm's part in order to push MMX into a settlement. The funder obviously would prefer to put up $125k and delay the trial hoping MMX will cave in.
Regardless of a judges decision finding in favour of chm, mmx have the perfect right to appeal the decision and delay for years if they wish.
So game on.
