If the conclusion is inevitable on the question of contract, then delay achieves nothing other than increased legal and court costs to the lossing party. The Plaintiff's need to decide whether they want that. IMO, they are in preservation mode now to save further conclusions or judgement that could result in prosecution by other parties in later cases.
