i don't think that there will be any problem in them getting the money for the court because there is always someone prepared to provide money on these sort of punts. the real question for shareholders is what dilution will it cost them. it could be argued as very high risk money and as such chm may have to either issue a huge number of shares to get it or alternatively offer away a big chunk of the spoils if they win to whoever funds it all. given the huge number of chm shares already on issue, even a big win under these circumstances may only be a big win to whoever is prepared to put up the funding from here on in. it is not just the security for costs, it is also a lot of very expensive long term legal bills for a case like this. if chm had $3m to throw at this then it might be different but as it is the company will have to pay the fiddler if they want to play...
