    True, but you are missing the point. The point being that as with the next case being withe the USA supreme court sometime this month, it is about , is the baker an artist as he claims he is. The baker in question claims he is no different to a sculptor, a builder, an artist...all who can refuse to make something for someone. The law of course states one cannot discriminate to sell anything to anyone off the shop floor, the issue here is about 'making' something. An artist can refuse to paint a portrait of you, a builder can refuse to build you a house, a sculpture can refuse to sculpt, but none can refuse to sell you something off the shop floor, the baker in question is saying the same thing.
