'A lawful direction' that could potentially lead personal harm? Really?
What sort of a direction is lawful if you are asked to commit what has been deemed by a court to be unlawful, albeit in Qld, but we do live in Australia don't we?
So let me understand this better, my boss instructs me to carry out a task that I think could harm, maim, injure or kill me, do I -
1. Carry out the task because I have been instructed
2. Point out the risks involved in complying with that instruction
3. Refuse that instruction until it is reviewed by an independent authority, safety officer, official, peer etc etc.
4. Go to my union for help? Yeh, good luck with that! Lets forget that one!
Under OH&S Legislation it is legitimate 'not to comply' if you think you will be harmed, then there are steps to eliminate, mitigate the harm, anyway that's the way it did work decades ago?
Even people wrongly gaoled are released when they are found innocent years later when the evidence clears them?
It's really simple just say I'm Sorry - we were wrong! What's so hard about that?
But I'm pragmatic that will never be uttered from any Police Commissioner's mouth!
