The continuous disclosureobligation in ASX Listing Rule 3.1, to publish price sensitive information, hascarve out for some confidential matters, including where to do so would breacha law. But a breach of a confidentiality agreement is not enough on itsown to attract this carve out.

The carve out alsoremoves the continuous disclosure obligations in respect of incomplete businessproposals or negotiations that are confidential , but only so long as confidentialityis maintained. Once confidentiality is breached, the carve out no longerapplies
