I missed that post of yours that has been moderated so I really don't know what was in it, before I can pass any judgment upon it.
But, let me tell you that, unless ASIC wrote in that letter to you that they are continuing the investigations, that would be the end. Did they actually said that in that letter to you ? For if they did, there is still some hope that it will come to a head.
Finally you posted a list of other issue that they may be investigating furher. And two of them raised my concerns, and they are:
1)Insider trading? 2)Naked selling?
Let me put my two bob's worth into these one, and you can take it or leave it.
Insider trading is a very bad thing on the eyes of the Regulators, and it is usually done by people on the inside, and not ordinary people or Institutions on the outside. So, I would let that go straight through to the keeper. And, as for the naked short selling part, I really don't know as to how you came up with that conclusion. For, IT IS ILLEGAL and has been TOTALLY BANNED by the Regulators. So I can't see how it can slip through the Regulator's finger/eyes, and unopposed. Beside, who would be so mad to risk loosing their licence to naked sell something that, at the time, the sp was going down of it's own accord due to what was released to the market. ? Why can't people realise, nor are able to come to grips, to the reality that what was released to the market at the time by way of a JORC, was like a bolt of lightning that came out of the sky and hit us all, you know where. Why can't people point the finger to the ones that were ramping this thing to unreasonable, unacceptable, and unbelieavable levels, instead of finding excuses and lay the blame on to someone else ?? The talks at the time were that we were going to have hundreds of million of tonnes of ore at a minimum of 2% copper and even a hell of a lot higher. When the JORC was released, IT WASN'T !!
Finally I can't remember ever reading in the ASIC's daily accumulated shares that are uncovered, any such figures relating to the "Naked selling shares that you quoted. Maxw, if someone is feeding you these informations, why don't you ask them to supply you these informations in black and white, then pass them on to ASIC as living proofs that it has occurred, it would help you in what you are trying to do you know ?
For what it is worth, to me, unless ASIC told you that they are continuing investigation along the problems that you have listed in your post, this issue is dead and buried now.
Max, there are legal firms out there, that do companies investigations for a living. So, may I suggest that you write to one of them if you want to go deeper. I am sure they will tell you if there is anything in it.
