There are two distinct actions- one is the request by the company for ASIC to investigate the report by FOSTERS. the actions by its officers and clients: the other is legal action initiated by CDU and Wayne McCrae personally no doubt having received appropriate counsel that there was sufficient evidence to establish a rightful claim for damages.
One would expect the later proceedings to drag on for some lengthy period unless there is an out of court settlement which personally I think would be unlikely. At this point of time , we do not know the individualls being sued. If they can justify their statements, the case against them collapses.If not, that is another matter.
