Yes I suppose the JTC can enter into an "option to acquire" agreement with PLV , and pay for the option.
At the completion of due diligence JTC can then exercise its right to acquire
This type of agreement is reasonably common.
Perhaps I was just thrown by the "hurt" terminology.
