I refer to the suggestion CXY should just accept it and pay the fine.

I write this as a former government employee in two (2) countries. One being NSW and the other being NZ.

In relation to NSW I was involved (witness) in numerous court matters bought against individuals. Majority of these were successful, but some were not. My point is that in my experience the governing bodies are likely to give up when push comes to shove.

Finally, I hope DERM isn't like some (A lot) of the government employees I worked with, e.g. "Just charge them and let the court decide." Usually having this attitude (Charge them and let the court decides) usually leads to a loss and on occasions costs being awarded etc.
