For memory, I think that for orphan drug status commercialisation can occur after phase 2 provided results substantiate. However, it was my understanding that a limited (adjusted) phase 3 model may still be required during the commercialisation process to consolidate data. From a quick online check, it would seem that it depends on how flexible FDA is.
