1.4 Recommendation to the Minister

Allow the appeal in part.

Appeal grounds relating to the flora and vegetation factor be upheld in part by amending

the recommended conditions, to address the risks from the potential introduction of

dieback, as follows:

1. Condition B1-3 is amended, and dieback is addressed in a new condition where:

a) environmental objectives are to prevent introduction and spread

b) no adverse impacts occur to vegetation within and surrounding the

development envelope.

2. Condition B1-6 is amended to establish the purpose of the DMP to also achieve the

rehabilitation outcomes of condition B4-1.

3. Condition B1-6 is amended to require the DMP to address contingency measures

should dieback occurrence be detected, such that the objectives and outcomes of

the amended condition B1-3 and condition B4-1 can be achieved.

4. A new contingency offset condition is added, where if dieback is introduced to the

development envelope and/ or impacts surrounding vegetation due to operational

elements of the proposal, the proponent must review and prepare a contingency

offset to counterbalance the level and significance of impacts from dieback to the

maintenance of biological diversity and ecological integrity of native vegetation.

It is otherwise recommended that all other appeal grounds be dismissed.

The final decision on whether the proposal may be implemented, and the conditions which

apply to any such implementation, is a matter for the Minister and key decision-making

authorities to consider under section 45(3) of the EP Act.
