Yeah, but by there own admission DMIRS were asked by DWER to refer the project to them. My bet would be that they then determine it requires a proper evaluation as a mining activity, which will trigger a referred to EPA proper.... and they'll reset the clock on themselves. I don't think you can game the system by asking to clear native vegitation and then dig out 1 million tons of sand.... pretty sure thats a no no.
