Because of State rights as part of the agreement at the time of Federation. Look at Bracks in Victoria who refuses to sign up to the Federal Water Rights Agreement.
He may be right of course, I'm no expert, but it does seem a bit ridiclous when the Murray crosses so many State boundaries.)
