If a private sector company for example BHP or ExxonMobil hired a contractor to carry our say drilling and they caused an accident, BHP or ExconMobil would be liable in the eyes of the public and rightly so, their fault for choosing a shonky contractor. Whichever way you look at it the government did not do their due diligence. Defending Dan Andrews who sits at the top is defending the indefensible in my opinion
