    Just to be clear, the judge never 'dismissed' the case.
    .
    He declined to exercise his discretion to continue the case on concerns of causing the Premier and others named therein 'stress'.
    .
    There was a timing technicality that he raised that meant the plaintiff was out of time (though it was scientifically impossible for them to be 'within time').
    .
    His discretion could have continued the case, which seems prudent given the impossibility, but he refused.Knock me over with a feather and paint the town Grey.
