I have found this definition of a priority claim very interesting:
"A claim of priority is a reference in a later filed patent application back to an earlier filed patent application."
If this definition is correct Agila certainly have no earlier patent application for an improved daptomycin injectable dating back prior to signing of the licensing agreement with POH on 30/10/2012.
