and following on from that Raiderup - a core tenet of equity (using plainer english and not the latin) is effectively that you can not gain from being naughty.
so if i take something from you and use it to make a profit then i cant just hand you back what i took and keep what i made with it...no - i have to share the gain as well. and if i didnt put anything in myself, well then i have to give you all the gain...constructive trusts. made simple.
