See below (page 34 of Dec 08 presenentation), for receivers to be appointed a company must be insolvent; unable to pay there debts as and when they fall due.
The refinancing in May 09 worst case is covered by available facilities of $842M and undrawn equity of $1.3B in the trusts.
Can you please tell me from the following how they are insolvent?
