It may turn out that Morsi despite being a dangerous fanatic and discharging his firearm did not actually kill anyone but did wound them (eg the policeman with pellets to the face), and that all the fatal shots came from other weapons.

Not that it matters in a court of law, as legal precedent has already been set previously in that case where two policemen took up firing positions and opened fire on an unarmed suspect in Sydney. One policemen shot the other due to their positions in each other's crossfire, but the person charged with the murder was..... the unarmed suspect. The prosecutor justified this as the unarmed suspect provoked the policemen to open fire with live rounds due to being a criminal. Which pretty much gives anyone carrying a gun for the government the ability to shoot anyone with impunity.
