A good early step for DGR in the courts on 17/5. Interesting read which gives a good understanding of how DGR and AJQ came into this situation.
Unethical practice of Shunkang. Putting in a takeover offer, getting access to the data room, promising to buy the companies convertible notes and instead of extending the interest date (as promised) put the company into admin. Their takeover offer was value in the $50M's and ending up with the company for in the $30M's.
Good to see DGR fighting in courts and showing Shunkang/Baker & McKenzie this is not acceptable under Australian Consumer Law. Unfortunately this process has been expensive for DGR and we have diluted our company trying to buy back AJQ.
Lets hope we end up with decent compensation for damages and we get another crack at AJQ's assets.
All will be told in December.
