It seems that they would have a compelling case if Trans Hex was actually they partner.
The basis seems that the first tender round was not technically closed due to the investigation request so there should have not been a second tender round.
It is more about the right of the government to award the contract rather than anything else.
From my interpretation Lucapa are squeaky clean.
