It looks like the ACCC is fighting an uphill battle to prosecute Farm Pride foods.
The subject of the court case mirrors the recent conduct of Andrew Forrest of Fortescue Metals Group (FMG). He called for collusive cuts to the supply of iron ore in that sector.
Interestingly, "competition lawyers say it will be very difficult for the competition watchdog to prosecute Mr Forrest over his offer to put a cap on Fortescue's production if others would do the same".

If these competition lawyers are right, it follows that the ACCC is unlikely to succeed in its existing legal action against Farm Pride.
