The Shree case was against the Federal Environment Minister's approval of mine commencement (which falls under the ambit of the EPBC Act), while the current State Environment Minister's approval is of the mine lease, which falls under a different statute (and which does not allow for legal recourse from third parties ;-)).
So, until we get to the federal approvals stage, the so-called "Shree line of attack" cannot be used to legally attack Venture, but only to throw mud through the media.
