Trading on materially relevent information not in the public domain, that doesn't fall under the auspices of mosaic theory would be considered insider dealing and is illegal. However proving it is devilishly difficult, so it goes on a lot, across the board.
You just have to look at all the many share price movements prior to announcements to see how much it happens.
