On the 11th March 2008 OPES wrote to me in an email in relation to the Superannuation Fund shares:
'We would never sell them because we cannot'.
Within a few weeks ANZ had taken them and sold them despite this admission by OPES THAT THEY COULD NOT SELL THEM BECAUSE THEY WERE HELD AS AN UNENCUMBERED SUPER FUND INCAPABLE OF BEING TRANSFERRED.
NOW TELL ME HOW THE ANZ COULD CLAIM TO HAVE A VALID TITLE TO THOSE SHARES.
