Many years ago crankshafts used to have dippers on them to splash the oil around the engine, sine pressure lube via an oil pump the crankshaft doesn't splash oil for lube.
In a modern car you would be having problems if the crankshaft was splashing oil, the oil would have to be way overfull.
And as previously mentioned, the seal would still leak even if the oil level was low.
