Directors insurance will most likely pay out any sum so it won't be coming out of the company coffers. If both S&G and IMF have jumped on the gravy train there is no doubt that there will be some form of compensation paid out. These companies do not take on the risk unless they are more than 75% confident they will win. By both lodging cases in the court I'd say the probability increases.

BTW. This won't go to court. A settlement will be reached prior to the big money being spent fighting it in court.
