He's been saying it for the last however many years, so if it ever does go up he'll be safe from insider trading claims because he can quote the thousand times he's said "A deal is just around the corner" and it hasn't been true.
Ultimately if people listen to a random guy on an internet forum who keeps saying "This is going to be the best thing since sliced bread/ice-cream/ice-cream sandwiches with pre-sliced bread" and use that as part of their investment choices, you've gotta ask whose fault is it really if they do their dough?
