I think that's a pretty fair summary, all things considered. Obviously, opinions on this forum will fall on either side of that. One hopes that in the true tradition of Christmas truce, Trêve de Noël, Weihnachtsfrieden, call it what you will, the troops will lay down their arms and cease hostilities during Yuletide. The only thing I'd say is that the amendments to the SOC were borne out of the need for the initial pleading to be expanded upon due to supervening events (publication of the SOR) and the requirement for greater particularity going to damages. That's sorted now. It's noted that the date for disputing categories of discovery documents has come and gone (14 Dec), so hopefully that's not agitated now and the parties can get on with providing those documents by 29 Jan. (I don't think the Judge would be too thrilled if one or both parties seek to have the matter brought back before the Court for directions during the vacation). Once the documents have been provided, things should start to take a bit more shape forensically. From what I've seen, the documents being sought largely go to the circumstances leading up to and surrounding the initial suspension. I haven't seen what documents ASX are seeking but they clearly must have most of them in order to have been able to formulate the SOR. Fingers crossed and all going to schedule, orders can be made on 5 Feb addressing matters such as witness statements, expert reports, conclaves, mediation, and the like, so as to keep it on the rails. If not too much of an imposition at this time of the year, would you be kind enough to shed some general light on the types of documents filed by both ISX and ASX, late on Christmas Eve, and their bearing on the progression of this case to trial? Thanks. And I'm also wondering if someone like @NashaNasha or @itzgr82balive has a copy of anything juicy?
