I believe ASX is “stuck between a rock and a hard place”
Every conceivable option available to ASX in an effort of getting out of this mess is a virtual “checkmate “
if they choose to settle out of court ... They possibly face a hefty compensation bill AND a definite class action will follow suit.
So what other option do they have? As you stated @durmaz I believe ASX Has no choice but to go all the way. ... they may think “ if we lose so be it we were going to pay a hefty price if we chose to settle out of court anyway. ”
With The court involvement maybe they believe it may be the lesser of the two evils???hoping the judge may curtail the damage awarded and win some “minor ” points and thus curtail the cost from a class action.
Either way I believe they find themselves in a pickle, especially now with the ASIC investigation concluded and all they can drum up is a civil case surrounding a few disclosure issues.... nothing that any logical person would agree justifies 15 month suspension and counting.
Anyhow it’s been a difficult 2020 for all (and thats an understatement), To all holders ( and even non holders) Merry Xmas and may 2021 be a healthy and prosperous year for all.
