If people are shareholders they'll get their cut if any money comes back, if people aren't shareholders then I'd assume they're doing it out of the goodness of their own hearts/to watch SS get skewered.
I wouldn't complicate it by promising money back to crowdfunding backers. As you say set the destination account to the lawyers (or an escrow of some sort). I'd move soon and see if you can get the campaign picked up as part of some of the media going on at the moment.
