I don't believe the claim can succeed though, certainly not in the manner touted by some.
It would set a legal precedent that would allow any entity that had ever loaned money for a purchase to seize the proportion of the property equivalent to the proportion of the original price they loaned.
Would you want you bank to repossess the $2m house you borrowed $300K from them to buy 5 years ago?
This is why this cannot proceed in the way some believe it could. A more likely award would be around $1m to account for capital return plus interest. This is less than 0.1c per share. Hardly an amount that would set CHM on fire.
IMO this is a manipulation play, probably to allow the CHM directors (and mates) to offload their shares at 4-5 times the price they paid for them.
